Who has the right to claim maintenance?

When two people have a common child and only one of them cares for him or her, while the other does not take the necessary care, or cares to a lesser extent, the parent who cares for the minor has a legal interest in filing a maintenance case against the other parent.

If you want to file a maintenance claim, or claim for an increase or reduction of an already awarded alimony support:

  • We will file the claim in the competent court;

  • If a claim has been filed against you for maintenance, an increase or reduction of an already awarded alimony support:
  • You will receive legal advice from our lawyer regarding the protection of your legitimate interests;
  • We will notify you of any evidence you have to provide in order to protect your interests;
  • We will draw up a response to the request and we will prepare all the necessary documents;
  • We will defend your interests before the court in the court proceedings and/or in the out-of-court settlement of your case.

How is maintenance support calculated?

  • The minimum amount of maintenance support for one child is equal to 25% of the minimum wage in the Republic of Bulgaria.
  • Depending on the needs of the child;
  • Depending on whether the child has specific needs / medicines, therapies, courses, trainings, etc./;
  • Depending on the financial situation of the other parent.
  • The maximum amount of maintenance support for one child depends mainly on the proven needs of the child and the financial ability of the parent to pay such amount of maintenance.

Retroactive recovery of maintenance claims

  • Retroactive recovery may be claimed for a maximum of twelve months from the date the petition was filed.

State fee:

Maintenance support cases are exempt from payment of state fees in order to start the proceedings.

Attorney’s fee:

According to Ordinance №1 of 9 July 2004 on the minimum amount of Attorney’s fee.
